PRIVACY OF INFORMATION POLICY

Please read this policy carefully to understand our policies and practices regarding your Personal Information and how we will use it. If you do not agree with our policies and practices, your choice is not to sign up for the Program. By registering for the Program, you agree to this privacy policy. This policy may change from time to time (see Changes to the Terms and Conditions and Reservation of Rights). Your continued participating in the Program after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

By completing the registration process for the Program, you authorize Parkland to collect and to disclose your Personal Information (your gender, postal address, and email address), (i) to our representatives and agents in order to administer the Rewards Program; (ii) to third parties where necessary or convenient for transfer of benefits earned in the Rewards program; (iii) to participating business who are investigating potential fraud or abuse; (iv) otherwise in accordance with the terms and conditions of this agreement.

Parkland may also use your Personal Information to comply with any court order, law, or legal process, including to respond to any government or regulatory request. Parkland may also disclose your personal information if it believes the disclosure is necessary or appropriate to protect the rights, property, or safety of Parkland’s customers, Participants, or others.

Parkland will use your Personal Information for purposes of administering the Program. Parkland may also use that information in its marketing database in order to notify you of Parkland’s special promotional offers.

Participants in the Program may choose not to form part of Parkland’s marketing databases or to be contacted for promotional reasons. Participants can choose not to allow Parkland to put their Personal Information in its marketing database by selecting the appropriate response during the registration process, or at any time after that by using any of the contact methods outlined under the Contact Information section below, or by emailing Parkland’s privacy officer at [email protected]. Participants may request that Parkland delete their personal information upon request by contacting JOURNIE Rewards Customer Service as outlined in the Contacts Section below.

From time to time, Parkland may enter into business relationships with businesses that do not form part of the Program, but that will provide Program members with various promotional offers, such as discounts if a Participant were to purchase their products or services of those businesses. In such an instance, Parkland will not provide such businesses with a Participant’s personal information but will provide them with the Participant’s registered Account number so that these businesses can confirm that the Participant is a Program member. An Account number itself cannot identify anyone, but if a Participant, on his or her own accord, provides such business with personal information, such personal information will be governed by that business’s privacy policies and not Parkland’s Privacy Policy. Participants’ disclosures of personal information to a third party will not change Parkland’s privacy obligations to Participant.

Parkland is a rapidly growing company and will from time to time need to reorganize and/or restructure. In such instances Parkland may be required to transfer your personal information to its subsidiaries, affiliates, and/or newly created Parkland entities. By participating in this Program, you give Parkland permission to disclose your personal information, without restriction, to its subsidiaries, affiliates and/or newly created Parkland entities. In the event of a merger, divestiture, dissolution, sale, or other transfer of Parkland’s assets you consent, without restriction, to allow Parkland to disclose your personal information to a buyer or other successor in interest.

Parkland assumes no responsibility or liability in the event that a Participant’s personal information is accessed by unauthorized persons due to any unauthorized use by third parties of the Participant’s password, whether such use resulted from some action or lack of action on the Participant’s part, including for example if the Participant has lost or misplaced their password, the Participant has given their password to a third party, or the Participant did not adequately protect their password. The safety and security of your information also depends on you. Where Parkland has given you (or where you have chosen) a password for access to certain parts of the Program, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

LICENSE AND INTELLECTUAL PROPERTY

No license under any patents, copyright or other intellectual property right is granted to Participant nor implied by participation in the Program.

All features, functionality, tools and content of the Program, are protected by copyright, trademark and other laws of the United States and foreign countries. You acknowledge and agree that the Program and its licensors, and all intellectual property rights therein are the exclusive property of Parkland.

CALIFORNIA PRIVACY RIGHTS

If you live in the State of California and participate in the JOURNIE Rewards program in California, you have may additional privacy rights under the California Consumer Privacy Act (CCPA). Some of these rights are:

  • The right to know about the personal information a business collects about them and how it is used and shared;
  • The right to delete personal information collected from them (with some exceptions);
  • The right to opt-out of the sale of their personal information; and
  • The right to non-discrimination for exercising their CCPA rights.

CHANGES TO TERMS AND CONDITIONS AND RESERVATION OF RIGHTS

Parkland reserves the right to change any of these Terms and Conditions, reward schedules, benefits and/or procedures at any time. Parkland will provide notice of the changes to the Terms and Conditions by posting a revised set of Program Terms and Conditions on the JOURNIE Rewards website at Journie.com. The revised Terms and Conditions shall automatically apply to Participant. You are advised to revisit the JOURNIE Rewards website at Journie.com from time to time to make sure you are aware of the most recent Terms and Conditions as they will be binding on you. Your use of the JOURNIE rewards program, after changes to the Terms and Conditions constitutes your agreement to such changes. Any changes to the Terms and Condition shall not affect awards/points already earned. The revised set of Terms and Conditions shall govern the Program as of such effective date.

PROGRAM TERMINATION

In the event that Parkland is unable to operate the Program as described in these Terms and Conditions for reasons beyond Parkland’s control, or if it comes into conflict with loyalty programs from other companies, the Program may be restricted, altered, suspended, or terminated without notice. Parkland may restrict, alter, suspend or terminate any aspect of the Program without notice. Participants release Parkland from all claims for Points if Parkland terminates the Program as explained herein.

Parkland reserves the right, in its sole discretion, to terminate Participant’s account for any failure to comply with these terms and conditions, and/or if Participant commits any fraudulent or illegal activity in relation to the Rewards program. In the event that Parkland terminates Participants Rewards program, Participant will forfeit all Points and rewards earned.

WAIVER

No delay or failure by Parkland to exercise any of its rights herein shall operate as waiver thereof or of any other right or remedy. If any provision of these Terms and Conditions is invalid or unenforceable, such provision will not affect the validity and enforceability of any of the remaining terms and conditions.

RELEASE OF LIABILITY AND INDEMNIFICATION

Participant expressly waives, releases, indemnifies, and holds Parkland harmless from any and all claims arising out of its participation in the Program, now known or hereafter known, against Parkland and its officers, directors, managers, employees, agents, affiliates, shareholders, successors, and assigns (collectively, «Releasees») on account of physical injury, psychological injury, illness, pain, suffering, disability, death, property damage, or financial loss arising out of or attributable to Participants participation in the Program, whether arising out of the ordinary negligence of Parkland or any Releasees or otherwise. Participants covenants not to make or bring any such claim against the Parkland or any other Releasee, and forever releases and discharges Parkland and all other Releasees from liability under such claims. This waiver and release do not extend to claims for gross negligence, willful misconduct, or any other liabilities that the law does not permit to be released by agreement.

GOVERNING LAW

All matters arising out of or relating to participation in the Program shall be governed by and construed in accordance with the internal laws of the State of New York without references to its choice of law provision or rule.

HEADINGS

The headings in these Terms and Conditions are for reference only and shall not affect their interpretation.

ACKNOWLEDGEMENT

BY AGREEING TO THESE TERMS AND CONDITIONS, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE COMPANY.
